Conditions of contracting and rental of ski and snowboard equipment.
- The contracting party of the rental service declares that the sports equipment object of this contract, identified by means of a paper or digital delivery note, is in perfect conditions of use, is of the requested quality, and appropriate to the height, weight and level of knowledge and sports technique given to the establishment by the user.
The staff of the establishment have sufficiently explained to you, and you have understood the operation of the equipment, accepting that the set of boards, bindings and boots may not be released in all cases, exempting the establishment from responsibility for this in case of injury. - The hirer of the rental service understands and accepts that the snowboard binding system and boots are not designed to release and do not release under normal circumstances. The user understands and accepts that the fixation system and boots is a system that does not release, therefore this system will not reduce the risk of damage or injury in the event of a fall, and will increase the risk of non-survival in the event of an avalanche, exempting of responsibility to the establishment.
- The contracting party for the rental service undertakes to be the sole user of the equipment and undertakes not to assign it or allow its use by any person other than the user.
- The user agrees to return the rented equipment on the date indicated on the delivery note or digital rental document issued by the establishment, assumes full responsibility for the care and custody of the same, forcing himself to reimburse the establishment for the amount of any damage that may suffer that is not strictly derived from its normal use; Likewise, it assumes the obligation of restitution to the establishment of value of the equipment in case of loss or theft.
- The user expressly accepts his responsibility for skiing or snowboarding, stating that he is aware of the risks involved in snow sports and exempts EL GNOMO SKI CLUB SL from any kind of responsibility, direct and indirect, for personal or material damage to himself or to third parties. that could be caused by the use of the leased equipment, which the user personally assumes.
- The contracting party for the rental service declares that they are acting on their own behalf, or, where appropriate, on behalf of the minor user identified in this document, who is authorized to contract on their behalf and accept the conditions of this contract and especially those liability limitations.
- The parties expressly waive the jurisdiction that may correspond to them and expressly submit to the Courts and Tribunals of Granada to resolve any controversy that may follow in the interpretation or education of these conditions.
- In compliance with the provisions of regulation (EU) 2016/679 of the European Parliament of the council of April 27, 2016 and in the current legislation on data protection, law 3/20/18, we indicate that the company EL GNOMO SKI CLUB SL will be responsible for processing the data that you provide us voluntarily through any of our means of collecting information. The purpose of the treatment is accounting, fiscal and administrative management, the invoicing of services or the making of commercial or promotional proposals and offers by EL GNOMO SKI CLUB SL. It is reported that said information may be transferred to collaborating companies and public entities to comply with legal obligations and to perform the service requested. The company EL GNOMO SKI CLUB SL will keep the data in accordance with current regulations. You have the right to obtain confirmation on how EL GNOMO SKI CLUB SL is treating your personal data, as well as to exercise your rights as interested parties by emailing info@luissanchezsport.com and may submit the pertinent claims to the Spanish Agency for Data Protection.
- Cancelation conditions
9.1 Cancellation before the delivery of the equipment with reservation payment.
Any cancellation made prior to 2 days before the agreed delivery period will entail 100% of the refund of the amount advanced to the client.
Any cancellation made between 2 days before the delivery period and the agreed delivery date will lead to a refund of the rent, with a deduction of 25%.
9.2 Cancellation after equipment delivery
In case of force majeure (illness, accident) during the rental period, the conditions remain in force. Only the equipment rented by the person concerned may be returned and will be billed proportionally to the number of days (used on presentation of a medical certificate and proof of return of the material to the store).
9.3 Cancellation for weather reasons
In the event of total closure of the ski slopes normally accessible from the equipment rental location, and only in this case, the rental days concerned will be reimbursed, upon presentation of a receipt issued by the CETURSA ski lift company.
In this case, the reimbursement will be made either by card, check or cash, depending on the method used for payment.
The reimbursement will be made, either by card deducting the financial expenses incurred by the electronic payment providers, or in cash if received in such a case. Any rental day started will not be refunded.
